Medical Negligence Compensation Claims

All of us are aware of the tremendous strain placed upon the NHS and on the clinicians who work within it. The needs of an ageing population, combined with reduced funding mean that our NHS Hospitals simply cannot cope. Government ministers and Hospital administrators admit that in many places the service is in crisis. It’s not only Accident and Emergency Department waiting times that are behind target. With this statement comes the realisation and understanding that clinical negligence claims on behalf of NHS patients have to be paid for from NHS funds, which are insufficient to meet the clinical needs of the nation. It is not a moral dilemma that we dismiss lightly. Nevertheless, we believe it is a fundamental human right of a mistreated patient to receive compensation and so does the NHS. From its initiation in 1946, the National Health Service has recognised that there will be clinical errors on the part of its clinicians and where patients suffer an injury, they should be compensated for those errors.

Case Study

A Hospital Porter suffers an injury to his Back and Neck after slipping on a Hospital corridor.

Lenny works at a hospital as a porter. He received a message to tell him to go to the main corridor to collect a wheelchair. The main corridor had a continuous line of glass windows along both sides. When he located the wheelchair, he manoeuvred it into position and used his right foot to unlock the brake. As he did so, he placed his weight on his left foot, which began to slip forcing his left foot under the wheels of the chair. He lost his balance and fell heavily on his lower back.
