Clinical Negligence and Cosmetic Surgery Claim Costs

At The Claims Partnership, we have the same three simple rules which apply to our Clinical Negligence and Cosmetic Surgery Claims services, as they do to the rest of our services.

  1. We never charge our client’s anything until the day they receive their compensation payment.
  2. We guarantee that all our client’s will receive a minimum percentage of the compensation they are awarded.
  3. We will agree the minimum percentage that our clients receive with them, before we start work on their claim.

For our Clinical Negligence and Cosmetic Surgery Claims service, we guarantee most of our clients that they will receive a minimum of 60% of the compensation we negotiate for them.

How does it work?

It’s No Win/No Fee

We offer all our clients a No Win/No Fee Agreement (sometimes called a Conditional Fee Agreement), where we promise we will not charge them for our costs, unless and until we win their claim. This is a legally binding agreement on our part. Put simply, it would be illegal for us to try to charge you, if you did not win your claim. We put this in our Agreements and highlight it in red.

This is a fundamental part of our Partnership Promises to our clients and we stand by it. It means that whatever happens with your claim, it will be a completely risk free venture for you.

We take out Insurance.

At The Claims Partnership, we insure every Clinical Negligence and Cosmetic Surgery claim that we take on as soon as the evidence in the case allows us. It works like this:

  1. We arrange this insurance policy for you.
  2. We pay for it ourselves.
  3. We promise that we will not ask you to pay for the cost of the insurance policy.
  4. We promise that the cost of the insurance policy will not be deducted from your compensation at the end of your claim.

The cost of the insurance premium varies from case to case and depends upon the type of claim, how much compensation you are awarded and at what stage of the claim process your claim settles. Premiums for Medical Negligence and Cosmetic Surgery claims are very expensive and usually start at £2,500. It is not unusual for these premiums to exceed £50,000.00.

Occasionally, the cost of the insurance premium is so high that it will take up most or all of the Success Fee, we take from your compensation. If this happens, then this is a risk that we have chosen to take and that we absorb. We will not allow your compensation to fall below the minimum percentage that we agreed with you at the start of your claim.

In Clinical Negligence and Cosmetic Surgery cases it is not usually possible to insure our case at the beginning. Insurance companies need some evidence, such as your medical records or more usually a Prospects Assessment from a Clinician, before they will insure a claim.

We take out a Success Fee

The Success Fee is the percentage of the award that we take out of your compensation claim if you win. We take this out on the day we send you the cheque or transfer the money to your bank account. The cost of insurance policies and the risk to us in agreeing to pay for this means that the Success Fee we charge has to be quite high. At The Claims Partnership, we try to ensure that the Success Fee we charge you is capped at 33.3% plus VAT or 40% of the compensation we recover for you. We are able to do this in the majority of our Medical Negligence and Cosmetic Surgery claims and means that in most cases we guarantee that you will receive a minimum of 60% of your compensation award.

We look at each claim on a case by case basis. Before we start work on your claim, we will let you know what the minimum percentage of your compensation will be. We won’t start work on your case until you have agreed that you are happy with this.

Is it possible that I will receive more than the minimum percentage of compensation you promise?

Yes it is. If part of your compensation award is for financial losses that you might encounter in the future such as medical costs, including physiotherapy or operation costs, then we will not apply our success fee to this money and you will receive it in full.

Similarly, if you receive compensation because you will not be able to earn as much money in the future because of your injury, then we will not apply our success fee to this aspect of your compensation either.

In these circumstances and in all cases where there is a ‘Future Loss’, we will not apply our Success Fee to that part of your compensation and you will receive more than the minimum percentage figure we have promised.

Case Study

A Train Station Employee Trips at the Entrance to the Train Station

Catherine worked as a Counter Assistant at a train station. She was walking into the station on her way to start work one morning. At the very entrance to the station was a small area covered with traditional paving stones. The paving stones were a little uneven. One of the paving stones was approximately 15 mm higher than the other one. As she stepped off it, she lost her balance, falling forwards and sideways and landing on her left arm. She suffered a serious fracture to her left arm and her left elbow.
