Spinal Injury Compensation Claims in Lancashire

Any injury to the spinal cord can be extremely serious, leading to numbness, weakness, tremendous pain and, in the worst cases, some form of paralysis and loss of bodily function. Surgeons and Anaesthetists must, therefore, take great care to avoid injuring the spine.

Not only are the injuries that arise from a clinical error involving the spine difficult, but the spinal injury claims arising from those mistakes are equally as complex. Assessing the longevity and severity of a spinal injury can be problematic and complex; this is why so many spinal injury claims result in complications or delays to settlement payouts. At The Claims Partnership, we have experience in dealing with difficult spinal cord injury claims. Together with a close alliance of medical experts whom we work with on these cases, we can help you to get compensation for your spinal injury.

Common Spinal Cord Injuries and Mistakes

  • Damaging the spine whilst administering an epidural.
  • Damaging the spine whilst administering injections of steroids or other substances at bodily locations that are close to the spine.
  • Failure to recognise a tumour in the spine and take appropriate clinical action.
  • Cauda Equina Syndrome.
  • Failure to diagnose a fracture of the spine.
  • Paraplegia.
  • Nerve Damage which is caused by a needle touching a nerve.
  • A spinal cord leak.
  • Cardiac Arrest.

Average Spinal Injury Payouts

While there are no set amounts in terms of compensation payouts for spinal injuries, if you look at examples of previous payouts, we may be able to paint a better idea as to the compensation which is paid out for different spinal injuries:

  • £100-£12,510 – Minor spinal injury (recovery between 1-2 years)
  • £12,510-£38,780 – Moderate spinal injury (recovery usually between 2-5 years)
  • £38,780-£69,730 – Serious spinal injury
  • £69,730-£160,980 – Severe spinal injury

How Long Does A Spinal Injury Claim Take?

While some claim types can be processed quite quickly, this is rarely the case with Spinal Injuries. The claiming process can be quite lengthy, mainly because it can take months, or even years to assess the impact that the injury has had on you. It is also of paramount importance that the amount of compensation you get is reflective of your suffering. After all, the aim of compensation is to help you deal with life-changing circumstances.

If the defendant admits fault early in the process, the claim can be resolved much quicker. However, if they don’t then the process can be drawn out. Sometimes, you may have fully recovered from your injuries before receiving your settlement payment.

Cauda Equina Injury Claims

Cauda Equina Syndrome is a spinal surgical emergency which can result in lower limb paralysis as well as loss of bowel, bladder and sexual functions. The syndrome affects 1-3 people per 100,000 population in England, and there are around 8,000 suspected cases every year. With stats like these, it’s no surprise that this form of spinal injury is one of the most claimed types of injury. Making a Cauda Equina claim can help to fund treatment and make it easier for you to live with this condition.

If you suffer from Cauda Equina Syndrome, you may be entitled to disability benefits such as Personal Independence Payments (PIP). However, disability payments may not be sufficient. In this case, you may wish to pursue compensation. Rough estimations of Cauda Equina compensation payouts can range from £1,540 to £5,860 for minor cases, to £5,860- £88,750 for moderate cases, or even £88,750- £160,980 for severe and serious cases.

Case Study

A Solicitor Trips Over a Box in an Untidy Office

Yasmin worked as a Senior Solicitor in the Civil Service. Whilst visiting the office library and after exchanging a book on the shelf, she turned away from the shelf and tripped over a box that had been left on the floor of the library, next to the bookshelf. She fell on her knees and jarred her bag.
