Pedestrian Accident Claims

In the UK, a pedestrian is injured by a motor vehicle every few minutes. More worryingly, each day, a pedestrian is killed or seriously injured every two hours.

  • A failure to allow a pedestrian the right of way. Pedestrians have the right of way whilst crossing streets, in both marked and unmarked crossing areas.

What evidence is needed for a pedestrian claim?

Police Report 

Police reports are one of the most handy and important pieces of evidence you can obtain in a personal injury claim. If the police were involved, you should obtain a copy of their report. We will request and pay for any Police Report routinely as part of our administration of your claim.

Medical Evidence

If you are making a personal injury claim, you should obtain some form of medical evidence that illustrates your suffering. Whether it is medical records, a doctor’s report, or details of your prescription records and reports, medical evidence can be a key part of ensuring a successful claim. We will request and pay for your medical records and a Medical Report routinely as part of our administration of your claim.

Photographic Evidence 

Pictures of the incident will no doubt improve the strength of your claim. Pictures of the scene of the accident, the vehicle involved in the accident, or just general pictures detailing the fallout of the accident will all help.

Witness Statements

If you, or someone else close to you, can gather statements from witnesses of the incident, then this will also benefit your claim. 

Driver and Vehicle Information

If possible, you should obtain driver and vehicle information. From the make and model of the vehicle to the driver’s license, information about the vehicle in an accident should be included within your claim. 

CCTV Or Dashcam Footage 

Video footage is one of the most effective forms of evidence, as it’s very hard to discredit. So, if there is CCTV footage of the event, or if the driver has a dashcam fitted to their vehicle, then it’s well worth factoring that into your claim.

Financial Records

If you want to reclaim expenses as part of your claim, be it loss of earnings or medical bills, you should keep financial records of your expenditures.

Pedestrian Accident Statistics

  • 398 pedestrians were killed in the UK in 2013. 24,000 other pedestrians were either slightly or seriously injured.
  • 89% of pedestrian fatalities occurred during normal weather conditions.
  • 73% of pedestrian fatalities occur in urban areas.
  • Male pedestrians are twice as likely to be killed as female pedestrians.
  • 32% of all pedestrian deaths occurred between 8 pm and midnight.

Is There A Time Limit To Make A Claim?

As with any personal injury claim, there is a time limit for you to make a claim. You have to make your claim within 3 years of the incident of the pedestrian claim.  While certain circumstances may affect this (mainly if the incident happened to a child or if the victim does not have the mental capacity to proceed with legal proceedings), this is the general rule.

A Factory Worker Trips Over a Tow Rope on the Shop-Floor

Graeme worked as a Production Operative for a large and well-known manufacturer of construction vehicles and plant. He was employed by them through an agency.
